4 effective ways creditors can collect judgments

On Behalf of | Mar 24, 2024 | Collections |

Dealing with debts owed can be a frustrating experience, as sometimes the courts are the only recourse for creditors seeking to collect outstanding debts. The courts may proclaim judgment allowing creditors to pursue various avenues for debt collection.

When judgment has been obtained, creditors can employ several effective methods to collect what is owed to them, including the following.

Wage garnishment

The creditor can request a court order for wage garnishment, wherein a portion of the debtor’s wages is withheld by their employer and directed to the creditor to satisfy the debt. This method can be particularly effective for ongoing debts, as it ensures a steady stream of payments until the debt is repaid or satisfied according to the terms of the judgment.

Property liens

Creditors can also place liens on the debtor’s property, including real estate or vehicles, which essentially means the creditor has a legal claim to the property until the debt is paid off. This can create significant pressure on the debtor, as it may impede their ability to sell or transfer ownership of the property until the debt is resolved.

Sherriff execution

Sheriff execution, also known as a levy or sheriff sale, involves the sheriff’s office seizing the debtor’s personal property to satisfy the debt. This can include seizing items such as vehicles, jewelry, electronics or other valuable assets. The seized property is then typically sold at auction, with the proceeds going towards repaying the debt owed to the creditor. This method can be particularly effective if the debtor has valuable assets that can be readily seized and sold to cover the outstanding debt.

Bank account garnishment

A creditor can also seek a court order for bank account garnishment, which allows them to access funds directly from the debtor’s bank account to satisfy the debt. Once granted by the court, the creditor can work with the debtor’s bank to freeze the account and withdraw funds up to the amount owed.

With sufficient legal guidance, creditors can determine the most effective strategy to pursue in order to enforce a judgment and recover the outstanding debt owed to them, better ensuring that their rights are protected within the bounds of the law.
